In a dramatic twist, a Virginia offshore wind developer has taken legal action against an order from the Trump administration that has halted their construction efforts. This order affects not only their project but also four others, citing concerns related to national security.
Located over 30 miles from Virginia Beach, Dominion Energy's initial two turbines are set to be part of what will eventually become a significant wind farm. This project is crucial for addressing the rapidly increasing energy demands driven by numerous new data centers in the region. In a lawsuit filed on Tuesday, Dominion Energy argues that the government’s decision is "arbitrary and capricious," as well as unconstitutional.
The U.S. Department of the Interior has not elaborated on the specific national security issues that led to the suspension of these five projects. A recent communication from the Bureau of Ocean Energy Management indicated a 90-day review period—potentially extended—aimed at assessing whether the perceived national security risks can be sufficiently managed.
Alongside Dominion's initiative, other affected projects include the Vineyard Wind project currently underway in Massachusetts, Revolution Wind in Rhode Island and Connecticut, as well as two projects in New York: Sunrise Wind and Empire Wind. Democratic governors from these states have expressed their intention to challenge this order, which they see as part of a broader attempt by the Trump administration to undermine the offshore wind sector in its campaign against renewable energy sources.
Dominion's wind project has been under development since early 2024 and was expected to begin operations early next year, with the capacity to supply electricity to approximately 660,000 homes. The company has indicated that the order's delays are incurring losses exceeding $5 million daily, primarily due to the costs associated with the ships involved in continuous construction. Ultimately, these financial burdens may fall on customers or the company itself.
Dominion has criticized the recent government order as yet another instance of irrational regulatory actions targeting the offshore wind industry, asserting that the administration continues to persist in such measures even when they are deemed unlawful.
In response to this urgent situation, U.S. District Judge Jamar Walker has scheduled a hearing for Monday afternoon regarding Dominion's request for a temporary restraining order, which could significantly impact the future of the project.
